Changes to the operation of financial agreementsFinancial agreements were introduced by the Amendment Act. Financialagreements dealing with all or any of the parties' property may now be made,either before or during marriage or after marriage breakdown. People areencouraged, but not required to make financial agreements.Schedule 5 of the Bill makes a range of amendments to the provisions relatingto financial agreements. In particular in order for a financial agreement tobe binding, each party is required to obtain independent legal advice as to thelegal effect of the agreement before concluding their agreement. Difficultieswith the extent of the advice required to be given, particularly in relation tothe financial aspects of the advice, have been raised by the legal profession.The Bill will amend the Act to change the certification requirements, inparticular, to remove the reference to the provision of financial advice by alegal practitioner.
